Intellectual Property Notice
Rights to the artwork, whether it be originals, commissions, prints, or any existing or potential reproductions, shall exclusively remain vested in Mel Thompson Art, even subsequent to the completion of the purchase. The acquisition of any item, whether original or otherwise, does not confer upon the customer the right to create an NFT from the piece, print and distribute it in any format, or reproduce it for profit or any other purpose.
Express written consent from the artist is required for collectors to reproduce the artwork in any manner. However, sharing images of purchased items on social media is encouraged and does not violate this provision.
Liability
Once the collector assumes possession of the goods, we bear no responsibility for their condition. Our obligation does not extend to refunding, exchanging, replacing, or compensating in any form for damages incurred due to mishandling by customers, such as smudging fingerprints on the white border, tearing fine art prints, or causing harm to the works.
Under the protections afforded by consumer rights, compensation for damage is applicable when products are impacted by postal services or when faulty merchandise is dispatched. Each print undergoes multiple inspections during quality control before being cleared for shipment, ensuring that only flawless reproductions are meticulously packaged for your enjoyment.
We urge customers to thoroughly and attentively read the product descriptions. Our responsibility does not encompass compensating individuals who fail to review the information provided in the product description prior to making a purchase. Please note that all prints come with borders, and these are factored into the final size as indicated in the listing.
Returns and Refunds
In the event of an issue with your order, rest assured that we are committed to resolving it. If there's a discrepancy or your item doesn't meet your expectations, we will make every effort to address the matter. Below outlines our return policies for each product category. A 14-day return policy is in place for eligible products. While we strive to provide accurate colour representations through our photography, please be aware that device calibrations may vary. If colour accuracy is a concern, we recommend viewing the item on multiple devices, such as desktops and iPhones.
To qualify for a return, the item must be in the same condition as when you received it.
Fine Art Prints (eligibility varies): Prints are highly delicate, and our stringent quality control and hygiene standards mean that most prints cannot be resold once returned. Only unhandled prints in their original packaging will be considered eligible for return. If returned prints are deemed unsuitable for any reason upon inspection, we reserve the right to deny a refund.
Originals (not eligible): All purchases of original artworks are final; we invest significantly in shipping them with their original stretchers directly to your door via courier.
Change of mind purchases are not eligible for returns, refunds, or exchanges. As per Australia's consumer protection laws, shipping fees for any returned items within good faith are not covered by the studio. The return shipment will only be covered by Mel Thompson Art in the case of faulty merchandise or products not covered under consumer guarantees.
Shipping Policy
Mel works tirelessly to promptly ship your orders. Please be aware that occasional delays in dispatching orders may occur, especially if the artwork gains traction on social media. We apologise in advance for any inconvenience and sincerely appreciate your patience.
It's important to note that extended delivery times are currently experienced within the Australia Post delivery network, and delays may occur. Unfortunately, express shipping is not available at this time.
For address changes, please notify us within 24 hours of purchase to ensure a successful redirect. Once the item has been dispatched from our studio, we are unable to modify the address. Kindly contact us through the contact page promptly.
Mel Thompson Art is not accountable for undelivered packages resulting from inaccuracies in the shipping addresses provided by customers. Please ensure at checkout to include complete and accurate mailing addresses.
Duties and taxes
The studio operates in Victoria, Australia, and is not liability for import fees related to any purchased products.
Checkout totals do not include applicable taxes and duties, as these are determined by the customs agency in the destination country. Import taxes vary among countries, and the customs agency will communicate with the recipient, whether by mail, phone, or email, to arrange payment for these charges, facilitating the onward shipment of the product to its destination.
Customers are responsible for settling any duties, value-added tax, or similar charges. In the event of refusal to pay these additional amounts, resulting in the return of the delivery to us, a refund of the purchase cost (minus the shipping costs to the country) will be issued, provided the product is in its original condition.
All items are declared at their purchase value for export, and there will be no falsification of documents under any circumstances.
